Welcome to CarvingTree.art. These Terms and Conditions ("Terms") govern your access to and use of the website located at https://carvingtree.art (the "Site") and any services, products, or custom engraving orders provided by CarvingTree.art ("Company," "we," "us," or "our").

By accessing the Site or purchasing products from us, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site or services.

CarvingTree.art specializes in laser engraving and cutting services. We offer personalized products made from materials including wood, metal, acrylic, and glass. We reserve the right to modify, discontinue, or update our product offerings and service descriptions at any time without prior notice.

Since we specialize in personalized items, custom orders are a core part of our business.

Approval: For custom designs, we will provide a digital proof for your approval. It is your responsibility to review all spelling, dates, and design elements.
Proof Approval Is Binding / No Typos Coverage: Once the Product Proof Approval Form <LEGAL_DOCUMENT:b7803f5a-968f-4b47-83bc-3ecf31771844> is signed (or otherwise approved in writing), the proof is considered final and authorized for production. You are solely responsible for the accuracy of all custom text and design details, including spelling, names, dates, numbers, and formatting. CarvingTree.art is not responsible for typos, mistakes, omissions, miscommunications, or errors that were present in the approved proof (even if those errors were originally entered by you, copied from prior messages, or overlooked during review).
Final Sale: Once you approve a proof, the sale is final. We cannot offer refunds or replacements for errors that were present in the approved proof.
Timeline: Production begins only after final proof approval.
Company IP: All content on this Site, including text, graphics, logos, designs, and photographs, is the property of CarvingTree.art and is protected by United States and international copyright laws.
Customer-Provided Designs / Rights & Permissions: If you provide any logo, artwork, photograph, graphic, design, or text for engraving or printing, you represent and warrant that you own the rights to that content or have obtained all necessary rights, licenses, consents, and permissions to use it for the intended purpose (including permission from any third-party rights holder and, where applicable, any person whose name, likeness, or photo is used). You agree to indemnify and hold CarvingTree.art harmless against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to content you provide, including claims of intellectual property infringement.
All prices are in USD.
Payment is required in full at the time of order unless otherwise agreed upon in writing.
We reserve the right to change prices or cancel orders due to pricing errors.
We currently only ship within the United States. We do not offer international shipping at this time.
We ship to the address provided at checkout. Please ensure it is accurate.
Risk of loss and title for items pass to you upon our delivery to the carrier (e.g., USPS, UPS, FedEx).
Shipping Delays: Delivery dates are estimates only. CarvingTree.art is not responsible for shipping delays, missed delivery dates, or carrier-related issues, including delays caused by the carrier, weather, service disruptions, incorrect address information, theft after delivery, or other events outside our reasonable control.
Non-Custom Items: Unused, non-custom items may be returned within 14 days of delivery at the buyer's shipping expense.
Custom / Personalized Items (No Returns / No Refunds): Due to the made-to-order nature of custom and personalized products, all sales of custom/personalized items are final and non-returnable and non-refundable once production has started and/or once the proof is approved. We do not offer refunds, returns, chargeback credits, or free replacements for customer-provided or customer-approved errors (including misspellings, incorrect dates, incorrect names, incorrect sizing, or other content/formatting issues).
Workmanship Defects Only: If your custom item has a material defect in workmanship (excluding natural material variation and excluding any issue shown in or consistent with an approved proof), our responsibility, if any, is limited to repair, replacement, or refund at our sole discretion.
Damaged Goods: If an item arrives damaged, please contact us within 48 hours with photos of the packaging and product.
Natural Material Disclaimer (Wood & Similar Materials): Many of our products use natural materials (including wood). Variations in grain pattern, knots, mineral streaks, color, texture, and engraving contrast are normal and are not considered defects. Engraving results may vary due to natural material characteristics.

To the maximum extent permitted by Louisiana law, CarvingTree.art shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to the use of (or inability to use) our products or website, even if we have been advised of the possibility of such damages. Our total liability is limited to the amount paid for the specific product in question.

Shipping Delays and Carrier Issues: Without limiting Section 5, CarvingTree.art is not liable for any damages, losses, or expenses arising from shipping delays, lost packages, or carrier performance, to the extent permitted by law.

Product Care, Safety, and Misuse: You are responsible for proper use, handling, storage, and care of all products. CarvingTree.art is not liable for damage to the product, other property damage, or injuries resulting from improper care or misuse, including (by way of example) placing hand-wash-only tumblers in a dishwasher, using abrasive cleaners, exposing products to excessive heat, soaking wood products, using items in a manner inconsistent with their intended purpose, or failing to follow any care instructions provided with the product or on the Site.

These terms are governed by the laws of the State of Louisiana. Any disputes shall be handled in the courts of Louisiana.
